Yvette Smith, a 47-year-old mother of two, called 911 from a friend’s home in Anderson, TX about half an hour after midnight on February 16, 2014, reporting an altercation between two men in the house. When Bastrop County police arrived, at least one of the men was in the front yard and the conflict had seemingly settled down. Responding officer Daniel Willis ordered Smith to come outside. As she opened the door Willis shouted “police!” and fired within seconds. Smith died in the hospital after being shot twice, once in the head and once in the stomach. Initial claims by police that Smith had been carrying a gun were quickly retracted. Daniel Willis was indicted for murder but a mistrial was declared when the jury deadlocked 8-4 in favor of guilty. In a subsequent bench trial, a judge acquitted Willis. In 2015, Bastrop County settled a civil lawsuit brought by Smith’s family for a reported $1.2 million. Previously, Willis had been rejected for jobs by other law enforcement agencies, once for failing a psychological exam.
